These Terms and Conditions ("Agreement") govern your use of the pension legal services offered by Kanchana ("we", "us", "our") in Pattaya, Thailand. By engaging our services or using this website, you agree to be bound by the terms set out below.

1. Definitions

"Service" refers to the pension review, application filing, and case handling services offered by Kanchana. "User" or "Client" refers to any individual engaging our services or using this website. "We", "Us", "Our" refers to Kanchana. "Content" refers to text, documents, and material provided through our services. "Agreement" refers to this Terms and Conditions document.

2. Acceptance of Terms

By submitting an enquiry, booking a session, or engaging any service, you confirm that you are at least eighteen years of age and have the legal capacity to enter into this Agreement.

3. Service Description

We provide Pension Review Sessions, Application and Filing Help, and Complete Case Handling for individuals with pension matters in Thailand. Availability of services may vary depending on the nature and complexity of an individual matter.

4. User Responsibilities

When engaging our services, you agree to:

• Provide accurate and complete information relevant to your matter
• Respond to reasonable requests for documentation in a timely manner
• Use our services for lawful purposes only
• Refrain from submitting fraudulent or misleading documentation

5. Intellectual Property

All written material, templates, and website content remain the property of Kanchana. Clients receive a limited, non-exclusive license to use materials provided for the purpose of their own matter. Materials may not be redistributed or used commercially without written consent.

6. Payment Terms

Fees for each service are set out clearly prior to engagement: ฿2,200 for a Pension Review Session, ฿5,800 for Application and Filing Help, and ฿11,500 for Complete Case Handling. All fees are quoted in Thai Baht. Refund requests are considered on a case-by-case basis, particularly where work has not yet commenced.

7. Service-Specific Terms

Timelines described for each service are estimates only and may vary depending on the responsiveness of relevant offices and the completeness of documentation provided. Case handling services involve ongoing communication and updates, but final outcomes depend on factors outside our direct control, including third-party office processing times.

8. Disclaimers

Our services are provided on an "as is" basis, with care and professional diligence. We do not promise particular results, as pension outcomes depend on regulatory decisions outside our control. Nothing on this website constitutes personalised legal advice until a formal engagement has taken place.

9. Limitation of Liability

To the extent permitted by Thai law, our liability for any claim arising from our services is limited to the fees paid for the specific service in question. We are not liable for indirect or consequential loss, or for delays arising from circumstances beyond our reasonable control, including force majeure events.

10. Indemnification

You agree to indemnify Kanchana against claims arising from inaccurate information you provide or from your misuse of our services.

11. Termination

Either party may end an engagement by providing written notice. Fees for work already completed remain payable. Provisions relating to confidentiality, liability, and intellectual property survive termination.

12. Dispute Resolution

This Agreement is governed by the laws of Thailand. We encourage clients to raise concerns directly with us in the first instance, so that matters can be resolved informally wherever possible. Any dispute not resolved informally shall fall under the jurisdiction of the courts of Thailand.

13. General Provisions

This Agreement constitutes the entire understanding between you and Kanchana regarding our services. If any provision is found unenforceable, the remaining provisions continue in effect. Failure to enforce a provision does not waive our right to do so later.

14. Changes to Terms

We may update this Agreement from time to time. Updates will be posted on this page with a revised date. Continued use of our services after changes take effect constitutes acceptance of the updated terms.
